What is required for someone other than an officer to apply

In some cases, people other than officers can apply to restore a society to the register. You must pay a restoration fee of $177.78 (plus GST) when you apply.

This guide covers the process if the society was registered under the Incorporated Societies Act 2022 (2022 Act) at the time it was removed.

Who can apply

Only some people can apply to restore an incorporated society to the register.

At the time the society was removed you must have been:

  • a member of the society
  • a creditor of the society
  • party to legal proceedings against the society
  • a liquidator or a receiver of the society.

Officers may also apply

If you are a committee member or other officer applying for restoration, the process and requirements are different than for other applicants.

The information you will need to provide

  • A restoration request in writing (Form IS22-RES) outlining the grounds for restoring the society.
  • Documents supporting your request. Examples include financial transactions or legal documents.

A restoration fee applies

To apply to restore your society you must pay a restoration fee of $177.78 (plus GST). Make sure you complete the payment details section of Form IS22-RES.

How to apply

You will need:

  • a RealMe® login, and
  • an online account with us.

Step by step

Follow these steps.

  1. Log in to the Incorporated Societies Register.
  2. Search for the society then select the society’s name to view its details.
  3. Go to the ‘Maintain Incorporated Society’ menu and select ‘Lodge Other Document’.
  4. Select ‘Creditor/Member Request to Restore’
  5. Upload your written request (Form IS22-RES) and any supporting documentation.
  6. Submit your application.

What happens next

We will review your application and contact you if we have any questions or need any further information.

We must give public notice

If we accept your application, next we will:

  • give public notice of the intended restoration, and
  • provide a period of 20 working days for any objections.

The notice is published on the Incorporated Societies Register website and the New Zealand Gazette.

We will email you to confirm the date the Registrar will publish the public notice.

Wait 20 working days to allow for any objections

Once the notice has been published, the public has 20 working days to object to the restoration of the society. We will email you if we receive any objections.

Restore the society to the register

If we have received no objection after 20 working days, the society will be restored to the register (generally the next working day).
